Release, Waiver of Liability, Assumption of Risk, and Indemnity Agreement

I wish to participate in courses and/or activities offered by the Lake Sawyer Hawks Radio Control Model Flying Club (“Hawks”).

Assumption of Risk. I understand that Hawks activities involve inherent risks, including but not limited to weather; equipment failure; collisions with aircraft, vehicles, or structures; loss of control; falls; the acts or omissions of other participants, spectators, or third parties; and limited access to immediate medical care. I voluntarily accept and assume all such risks and any resulting injury (including death), property damage, or loss.

Release and Covenant Not to Sue (Adults). To the fullest extent permitted by Washington law, I release and agree not to sue Hawks, its directors, officers, instructors, members, volunteers, event organizers, landowners (including King County), and their agents (collectively, the “Released Parties”) for claims arising out of my participation in Hawks activities, including claims alleging the ordinary negligence of any Released Party. This release does not extend to claims that cannot legally be released, including gross negligence or willful or reckless misconduct.

Indemnity. To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from any third-party claims, demands, or liabilities (including reasonable attorneys’ fees) arising out of my participation.

Medical Authorization. In the event of injury or medical emergency during Hawks activities, I authorize emergency medical care as deemed necessary by qualified personnel. I am responsible for all associated costs.

Rules and Safety. I agree to follow all Hawks, AMA, and site-specific rules and any instructions given by club officials or event staff.

Governing Law; Venue; Severability. This Agreement is governed by Washington law. Exclusive venue for any dispute shall be in the state or federal courts located in King County, Washington. If any provision is held invalid, the remainder shall be enforced to the maximum extent permitted.

Acknowledgment. I am 18 years of age or older, I am legally competent to sign, I have read this Agreement, understand it, and sign it voluntarily.

Parent/Guardian Acknowledgment & Indemnity (Required if Participant is under 18)

I am the parent or legal guardian of the minor named below (“Minor”). I consent to the Minor’s participation in Hawks activities and agree that all risks described above are understood and accepted on the Minor’s behalf to the extent permitted by law. I understand that under Washington law, I cannot waive or release the Minor’s own claims for negligence. However, to the fullest extent permitted by law, I (on my own behalf) release and agree not to sue the Released Parties for my own claims arising from the Minor’s participation, and I agree to defend, indemnify, and hold harmless the Released Parties from any claims brought by or on behalf of the Minor, except to the extent such claims cannot legally be indemnified.

Medical Authorization for Minor. I authorize emergency medical care for the Minor as deemed necessary by qualified personnel and accept responsibility for associated costs.
